Terms & Conditions — GoatAscend

These Terms and Conditions (the "Terms") govern the use of the GoatAscend mobile application (the "App"), operated by Juan Marcos Villar, a natural person residing in the Argentine Republic (the "Owner").

By creating an account or using the App, you accept these Terms. If you do not agree with them, do not use the App.

1. Service description

GoatAscend is a physical training application that offers:

• Training plans generated by an algorithm, adjusted to your data and progress.
• Recording of sessions, sets, weights, and perceived effort.
• A progression system with missions, streaks, experience, and ranks.
• Tracking of your progress over time.

Some features are free and others require the premium subscription described in section 3.

2. User account

• To use the App you must create an account with a valid email address and a unique username.
• Each person may have one single account.
• You must be at least 13 years old to create an account.
• You agree to provide truthful data and to keep it up to date. Profile data (such as date of birth and gender) is used for training calculations; false data may produce inappropriate plans.
• You are responsible for keeping your access credentials confidential and for all activity carried out from your account.

3. "Premium" subscription

• The Premium subscription is optional and unlocks additional App features.
• It is an auto-renewing subscription, available in monthly and annual plans.
• The applicable prices and currencies are shown on Google Play at the time of purchase.
• There may be a limited-time launch offer, available for a set period after registration. Its conditions will be stated in the offer itself.
• The subscription is managed and cancelled through Google Play (Google Play → Payments and subscriptions → Subscriptions). The App cannot cancel it for you.
• Cancellation takes effect at the end of the period already paid for: you keep Premium access until that date and no further charges are made.
• Refunds are governed by Google Play's refund policies.
• Prices may change. Any price change will be communicated with prior notice and applied according to Google Play's rules; you will always be able to cancel before a new price applies.
• Billing is processed by Google Play. We never see or store your payment data.

5. Acceptable use

When using the App, you agree not to:

• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App or its services.
• Use the App fraudulently, including manipulating streaks, experience, ranks, missions, or offers and subscriptions.
• Impersonate another person or create accounts with third-party data.
• Access or attempt to access, without authorization, systems, other people's accounts, or other users' data.
• Use the App for illegal purposes or purposes that infringe third-party rights.

6. Intellectual property

The App, its code, design, texts, graphics, logos, the GoatAscend name and brand, the exercise catalog, and the progression system are the property of the Owner or are used under license, and are protected by intellectual property laws.

You are granted a limited, personal, non-exclusive, and non-transferable license to use the App in accordance with these Terms. This license does not transfer any ownership rights to you.

The training data you record belongs to you; we process it according to our Privacy Policy.

7. Service availability and limitation of liability

• We make a reasonable effort to keep the App available and working correctly, but we do not guarantee uninterrupted or error-free availability. There may be interruptions due to maintenance, technical failures, or causes beyond our control.
• The App is provided "as is" and "as available."
• To the maximum extent permitted by applicable law, the Owner shall not be liable for indirect damages, loss of profit, or loss of data arising from the use of or inability to use the App.
• Nothing in these Terms limits liabilities that cannot be limited under applicable law, including the consumer protection rules of the Argentine Republic.

8. Account termination

We may suspend or delete your account if you breach these Terms, in particular the acceptable use rules in section 5, or if your account is used fraudulently. Where reasonable, we will give you prior notice and an opportunity to remedy the breach.

You may delete your account at any time from the App (the "Yo" (profile) tab → Settings → Delete account) or by email, in accordance with the Privacy Policy.

9. Changes to these Terms

We may modify these Terms. Relevant changes will be announced within the App before they take effect. If you continue using the App after the changes take effect, you will be deemed to accept them. If you do not agree, you may stop using the App and delete your account.

10. Governing law and jurisdiction

These Terms are governed by the laws of the Argentine Republic. Any dispute arising from these Terms or from the use of the App shall be submitted to the competent courts of the Argentine Republic, without prejudice to the mandatory public-order rules that establish a different jurisdiction in favor of the consumer.
